4. SMS Marketing, Alerts, and Appointment Reminders

We offer optional SMS/text messaging for marketing, promotional offers, project updates, alerts, and appointment reminders (the "SMS Program").

4.1 Consent and Opt-In. By providing your mobile phone number on our Site, in person, over the phone, via keyword, QR code, or any other sign-up method, and by submitting any form that references SMS or text communication, you consent to receive recurring automated and non-automated text messages from Butler & Associates Construction, Inc. at the number you provide. Consent is not a condition of purchase. Your consent constitutes your electronic signature under the Telephone Consumer Protection Act (TCPA) and E-SIGN Act.

4.2 Message Frequency and Costs. Message frequency varies based on project status and communication preferences. Message and data rates may apply. Check your mobile plan for details.

4.3 Opt-Out. You may opt out at any time by replying STOP to any message. You may also request removal by contacting us using the information in Section 11. After you send STOP, you may receive a final confirmation text. No further marketing texts will be sent to your number unless you re-opt-in.

4.4 Help. For help, reply HELP to any message or contact us using the information in Section 11.

4.5 Eligibility. You must be the account holder or have the account holder's permission to enroll a mobile number. You agree to provide a valid mobile number and to notify us promptly if your number changes or is reassigned.

4.6 Delivery. Delivery of messages is subject to effective transmission from your wireless carrier and is outside our control. Carriers are not liable for delayed or undelivered messages.

4.7 Message Types. Messages may include: marketing and promotional content, project updates, appointment confirmations and reminders, scheduling changes, service notices, and account-related alerts.

4.8 Data and Privacy. We use information collected through the SMS Program in accordance with our Privacy Policy. We do not sell your mobile phone number. SMS opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes.

5. Email Communications

By providing your email address through our website or in connection with our services, you may receive emails from Butler & Associates Construction, Inc. including project-related communications, promotional offers, company updates, and service notifications.

Every marketing email includes an unsubscribe option. You may opt out of promotional emails at any time. Transactional emails related to active projects (invoices, receipts, contract documents, scheduling confirmations) are not subject to marketing opt-out and will continue as necessary for service delivery.

Pricing information, cost calculators, and estimates displayed on the Site are for informational and planning purposes only and do not constitute a binding offer, contract, or guarantee of final pricing. All final pricing is confirmed through a signed Outdoor Living Space Agreement after an in-person consultation.

8. Limitation of Liability

To the fullest extent permitted by law, Butler & Associates Construction, Inc. shall not be liable for any damages arising from your use of — or inability to use — the Site, including but not limited to direct, indirect, incidental, consequential, or punitive damages, regardless of the cause of action.

9. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any legal action or dispute related to this Site or these Terms shall be filed exclusively in a state or federal court located in Madison County, Alabama.
